In brief

  • SiteVerity is a tool for recording inspections and making reports. You’re responsible for your inspections, your professional judgement and what your reports say.
  • Every organisation gets two free projects with every feature. Professional is an App Store subscription: you buy it, cancel it and ask for refunds through Apple.
  • Your content belongs to you. We use it only to run SiteVerity, and, subject to the update restrictions in section 10, you can open, share, export and delete it, with or without a plan.
  • Keep your own copies of your reports and exports. We can’t promise that SiteVerity will never be interrupted, and we keep backups for only 35 days.
  • Our liability to you is limited, except where the law doesn’t allow limits.
  • These terms are governed by Scots law. MOORFORGE LTD is registered in Scotland.

1. About these terms

Who we are

SiteVerity is made by MOORFORGE LTD, a company registered in Scotland (company number SC882267), whose registered office is at 5 South Charlotte Street, Edinburgh, EH2 4AN, United Kingdom. “We”, “us” and “our” mean MOORFORGE LTD.

What these terms cover

These terms apply to the SiteVerity app for iPhone and iPad, the online service behind it (including sync, storage and share links) and our website. We call all of these “SiteVerity”.

These terms are also the licence agreement for the app. They replace Apple’s standard licence agreement, and section 18 contains terms that Apple requires.

These documents also apply:

  • our privacy policy, which explains how we handle personal data;
  • our cookie statement, which covers our website;
  • the data processing terms in Schedule 1, which apply to personal data in your projects.

Who “you” are

“You” means the person who accepts these terms. If you use SiteVerity for a business, including your own business as a sole trader, “you” also means that business, and you confirm that you’re allowed to accept these terms on its behalf.

SiteVerity is for business use

SiteVerity is designed for professionals and businesses, such as surveyors, inspectors, letting agents, housing officers and property managers. If you use it as a consumer, outside any trade, business, craft or profession, section 16 explains how these terms apply to you.

Accepting these terms, and how our contract is made

By creating an account or using SiteVerity, you accept these terms. If you don’t agree with them, don’t use SiteVerity.

The app’s sign-in screen says that by continuing you agree to these terms and confirm you’ve read our privacy policy, with links to both. Our contract is made when you continue from that screen and your account is created. We record on your account which version of these terms you accepted, and when. These terms are in English, and the current version is always on our website.

2. Your account and organisation

  • You must be 16 or over to use SiteVerity.
  • Give us accurate details and keep them up to date.
  • Keep your sign-in details secure, and don’t share your account. Each account is for one person.
  • You’re responsible for what happens under your account. If you think someone else has used it, tell us straight away at support@siteverity.com.

If you sign up with an email address and password, you’ll need to confirm the address before you can save any work in SiteVerity. Accounts without an email address can’t be used.

When you create an account, SiteVerity also creates an organisation for you, and you’re its owner. The organisation holds your projects, your branding and your subscription. The owner controls the organisation’s details, and only the owner can buy or manage its subscription.

SiteVerity doesn’t yet let owners invite other people into an organisation. If we add teams, we’ll update these terms.

3. Free projects

  • Every organisation gets two free projects, with every feature and every template. You don’t need a card, and there’s no time limit.
  • The free projects are the first two that your organisation ever creates. Deleting one doesn’t give it back: our servers keep the count.
  • Reports from free projects say “Generated by SiteVerity” in the footer.
  • If you create a third project without a plan, for example while you’re offline, it’s saved but stays view-only until your organisation subscribes.

4. Professional subscriptions

What you get

Professional lets your organisation create as many projects as it needs, with every feature and every template, and with no SiteVerity footer on its reports.

Prices

Professional is available at founding prices of £19.99 a month or £159.99 a year. Prices include VAT, as charged by Apple. The price the App Store shows you when you buy is the price you pay, and prices in other countries may differ.

Buying, renewing and cancelling

  • Only the organisation’s owner can buy Professional. You buy it in the app, through Apple’s App Store, and Apple takes payment from your Apple account when you confirm the purchase.
  • Your subscription renews automatically at the end of each month or year, and Apple charges you for the next period, until you cancel. Apple asks you to cancel at least 24 hours before the renewal date to avoid being charged again.
  • You manage and cancel your subscription in your Apple account settings, not in SiteVerity. If you cancel, Professional continues until the end of the period you’ve paid for.
  • Deleting the app or your SiteVerity account doesn’t cancel your subscription.
  • Professional can’t be shared through Family Sharing.

Refunds

Apple handles all refunds, under its own terms, and we can’t give App Store refunds ourselves. To ask for a refund, use Apple’s Report a Problem page.

If SiteVerity isn’t working as described, please email us first at support@siteverity.com. We’ll try to put it right, and if we can’t, we’ll help you with your refund request to Apple.

If you’re a consumer, Apple’s UK terms give you 14 days from the date of your receipt to withdraw from a new purchase, with some exceptions. The details are in Apple’s terms, and Apple handles the refund. Nothing in these terms limits your legal rights.

Price changes

We may change Professional’s prices for a good reason, such as a change to what Professional includes, a change in our costs of providing it, or a change in tax. A founding price only changes as “Founding prices” below explains. If we raise the price of your subscription, Apple will tell you before the new price applies, as its rules require. Where Apple’s rules or the law need your agreement, your subscription won’t renew at the higher price unless you agree. You can cancel before any change takes effect.

Founding prices

If you subscribe at a founding price, you keep that price for as long as you stay subscribed without a break. The only exception is a change in tax, such as VAT, that changes the price Apple charges. If your subscription ends and you come back later, you’ll pay a founding price only if it’s still on sale; if it isn’t, you’ll pay the standard price at the time.

Team plans

We may offer team plans in future, with their own prices and terms.

5. Without a plan

If your organisation doesn’t have Professional, because it has used its free projects or its subscription has ended, then subject to the update restrictions in section 10, you can:

  • open every project;
  • view and share the reports you’ve already made;
  • export your records as CSV files;
  • delete anything.

A required update can pause these features, as section 10 explains.

Share links you’ve already made keep working until they expire, reach their download limit or you stop them.

Projects outside the free allowance become view-only. You can’t add to them or change them, or make new reports or share links in them, until your organisation subscribes. We never hold your data hostage.

6. Your content

“Your content” means everything you put into SiteVerity, including projects, records, notes, photos, markup, floor plans, signatures, logos and report wording, and the reports you make.

You own it

You, or your organisation, own your content. We don’t claim any ownership of it.

Our licence to use it

You give us permission to store, copy, process, transmit and display your content only as far as we need to provide SiteVerity to you, keep it secure, support you and meet our legal obligations. That includes making your reports and serving the share links you create. The permission extends to the providers who host and run SiteVerity for us, such as Google, under our contracts with them. This permission ends when your content is deleted from our systems, as our privacy policy describes. We don’t use your content for anything else.

Keeping it confidential

We keep your content confidential. We use it only to provide SiteVerity, as this section describes, and we disclose it only as these terms and our privacy policy allow, or as the law requires. If we give you information about SiteVerity that isn’t public, such as details of our security, please keep it confidential in the same way.

Your responsibilities

You’re responsible for your content. You confirm that:

  • you have the right to use everything you add, including photos, logos and drawings;
  • your content doesn’t break the law or infringe anyone else’s rights;
  • you handle other people’s personal data in your content lawfully. You’re the controller of that data, so you must have a lawful basis for recording it, tell people how you use it where the law requires, and take particular care with sensitive information, such as anything about someone’s health.

Feedback

If you send us ideas or suggestions, we may use them freely, without owing you anything.

7. Your professional responsibility

SiteVerity is a tool. It isn’t a surveyor, an inspector or an adviser. We don’t inspect properties, check your findings or review your reports.

You’re responsible for:

  • choosing a template that suits the job;
  • your inspection, and your findings, ratings, measurements and recommendations;
  • everything your reports say, including wording that comes from a template, such as introductions, standard text and dates the app works out for you;
  • meeting your own professional, regulatory and legal obligations, including any standards that apply to your work and your professional indemnity insurance.

Templates and their wording aren’t legal or professional advice. Some templates refer to legislation and official guidance. We write them carefully, but laws and guidance change, so check the current position before you rely on a template. A template that refers to a law or standard doesn’t make a report comply with it.

If you add wording about RICS or its standards to a report, that wording is yours. Using SiteVerity doesn’t make you or your firm regulated by RICS, and it doesn’t mean that RICS has approved SiteVerity or your reports. Make sure your reports describe your professional status accurately.

You can create a share link for a report. Anyone with the link can download the PDF, without an account or a password, until the link expires, reaches its download limit or you stop it. Deleting the report also stops its links. Stopping a link or deleting its report takes effect when the request reaches our server.

You’re responsible for who you send links to, and for the reports you share. Don’t post links anywhere people you don’t intend to share with could find them.

We may switch off a link if we believe it’s being misused, if it puts security at risk or if the law requires it.

9. Acceptable use

Don’t use SiteVerity to:

  • break the law, or help anyone else to break it;
  • make reports you know to be false or misleading;
  • store or share content that infringes anyone’s rights, or that is unlawful, defamatory or harassing;
  • upload viruses or other harmful code;
  • try to get into accounts, data or systems you’re not allowed to, or test our security without our written permission;
  • disrupt or overload SiteVerity, or scrape or copy it with automated tools;
  • copy, modify or reverse engineer the app, except as far as the law allows;
  • resell SiteVerity, or let other people use it through your account;
  • get round the free allowance, plan limits or other restrictions.

10. Availability, offline use and your copies

Offline use and sync

You can record on site without a signal: records, photos, markup, floor plans, making PDF reports and CSV export all work offline, and your changes sync when you’re back online. Some things need a connection, such as signing in for the first time on a device, share links, purchases and opening items made on another device.

Until it has synced, your work exists only on your device. The app’s own database and files are left out of device backups, so if you lose your device or delete the app before your work has synced, it’s gone.

No guarantee of uninterrupted service

We work hard to keep SiteVerity running, but we can’t promise that it will always be available, uninterrupted or free of errors. We may need to pause it for maintenance, and it relies on services provided by others, such as Apple and Google.

Keep your own copies

We back up our database every day and keep each backup for 35 days, but backups can’t replace your own copies, so don’t rely on SiteVerity as your only copy. Export your reports as PDFs and your records as CSV files, and keep them somewhere safe.

Updates

Keep the app up to date. If a version of the app becomes too old to work safely with the service, the app asks you to update it. Until you do, it keeps your work on your device but doesn’t send changes or make new reports or CSV exports, and in an emergency it may not open at all except to update, contact support or delete your account. Once you update, your work is sent as usual.

11. Changes to SiteVerity

We improve SiteVerity over time, and we may add, change or remove features. If a change significantly reduces what Professional gives you, we’ll tell you in advance, and you can cancel your subscription.

If we decide to close SiteVerity, we’ll give you at least 60 days’ notice so that you can export your content, and we’ll stop all subscription renewals.

12. Our intellectual property

We, or the people we license from, own SiteVerity, including the app, the templates and their wording, the report designs and the website. This doesn’t include your content.

We give you a non-exclusive, non-transferable licence to use SiteVerity for your work, in line with these terms. You may use template wording in the reports you make with SiteVerity. Don’t copy our templates or designs for any other purpose, such as building a competing product.

The app includes software from other companies, used under their own licences.

13. Data protection

Our privacy policy explains how we handle personal data when we decide how it’s used, such as your account details.

When we handle personal data in your projects, we act on your behalf as your processor. The data processing terms in Schedule 1 apply to that data, and you agree to them by accepting these terms.

14. Suspension and ending

If you want to stop

You can stop using SiteVerity at any time. To end your subscription, cancel it in your Apple account settings. To delete your account, use Delete account in the app’s Settings, as our privacy policy explains.

If we suspend or close your account

We may suspend or close your account if:

  • you seriously or repeatedly break these terms;
  • you use SiteVerity unlawfully, or in a way that risks harm to us, to other users or to anyone else;
  • the law, a court or a regulator requires us to.

Where we reasonably can, we’ll tell you why first, give you a chance to put things right and let you export your content. We may act straight away if the problem is serious or the law requires it.

What happens next

When your account ends, your right to use SiteVerity ends, and we delete your data as our privacy policy describes. Any part of these terms that by its nature should continue, such as sections 15, 16, 19 and 20, continues to apply.

15. Our liability to business customers

This section applies if you use SiteVerity for a business. If you’re a consumer, section 16 applies instead.

What we don’t limit

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law doesn’t allow us to limit.

What we’re not responsible for

We’re not liable for:

  • loss of profit, revenue, business, contracts, goodwill or anticipated savings;
  • indirect or consequential loss;
  • loss caused by what your reports say, by your professional work, or by anyone relying on your reports, except to the extent that the loss is caused by a fault in SiteVerity or by our breaking these terms;
  • loss or corruption of data, unless we caused it by breaking these terms. Even then, we’re liable only for the reasonable cost of restoring it from your own copies, or, for work you couldn’t yet have exported or where SiteVerity’s export of it was faulty, the reasonable cost of recreating it;
  • delays or failures caused by events outside our reasonable control.

Our maximum liability

Our total liability to you, however it arises (including through negligence), is limited to the greater of £100 and the total you paid for SiteVerity in the 12 months before the event that led to the claim.

Our promises

We’ll provide SiteVerity with reasonable care and skill. Apart from what these terms say, we make no promises about SiteVerity, as far as the law allows.

Your responsibility to us

If someone makes a claim against us because of your content, your reports, or your breach of these terms or of data protection law, you’ll compensate us for our reasonable losses and costs, to the extent that the claim arises from those things and not from our own breach of these terms. If that happens, we’ll:

  • tell you about the claim promptly;
  • consult you about how it’s defended, and give you the information you reasonably need;
  • not settle it without consulting you first;
  • take reasonable steps to keep our losses and costs down.

16. If you’re a consumer

SiteVerity is designed for business, but if you use it as a consumer:

  • Your legal rights. You have rights under consumer law, including the Consumer Rights Act 2015. In particular, digital content must be as described, fit for purpose and of satisfactory quality, and services must be provided with reasonable care and skill. Nothing in these terms affects those rights.
  • Cancelling. Apple’s UK terms give you 14 days from the date of your receipt to withdraw from a new purchase, with some exceptions (see section 4).
  • What we’re responsible for. We’re responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We’re not responsible for loss that wasn’t foreseeable, or for any business losses. Section 15 doesn’t apply to you, apart from its first paragraph (“What we don’t limit”).
  • Courts. If you live elsewhere in the UK, you can bring a claim in your local courts as well as in Scotland, and you keep the protection of the law where you live.

17. Changes to these terms

We may update these terms, for example to reflect changes to SiteVerity or to the law. We’ll tell you at least 30 days before a change that affects you takes effect, in the app or by email, unless we have to make it sooner for legal or security reasons. If you don’t agree with a change, you can stop using SiteVerity and cancel your subscription before it takes effect. If you carry on using SiteVerity after that, the new terms apply.

The version number and date at the top show when these terms last changed.

18. Apple’s terms for the app

Apple requires these terms to include the points below. They apply to the app as downloaded from the App Store. If anything in this section conflicts with the rest of these terms, this section applies.

  1. Our agreement. These terms are between you and MOORFORGE LTD only, not Apple. MOORFORGE LTD, not Apple, is solely responsible for the app and its content. These terms don’t set usage rules for the app that conflict with the Apple Media Services Terms and Conditions or the Volume Content Terms.
  2. Your licence. Your licence to the app is a non-transferable licence to use it on any Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow. Other accounts associated with the purchaser may also access, acquire and use the app through Family Sharing, volume purchasing or Legacy Contacts.
  3. Maintenance and support. We alone are responsible for any maintenance and support for the app, as these terms describe or the law requires. You and we agree that Apple has no obligation at all to provide maintenance or support for the app.
  4. Warranty. We alone are responsible for any product warranties, whether express or implied by law, to the extent they aren’t effectively excluded. If the app fails to meet an applicable warranty, you may tell Apple, and Apple will refund the price you paid for the app, if any. As far as the law allows, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, not Apple’s.
  5. Claims about the app. You and we agree that we, not Apple, are responsible for dealing with any claims by you or anyone else relating to the app, or to your possession or use of it, including: (a) product liability claims; (b) any claim that the app fails to meet an applicable legal or regulatory requirement; and (c) claims under consumer protection, privacy or similar laws. These terms don’t limit our liability to you beyond what the law allows.
  6. Intellectual property claims. You and we agree that if anyone claims that the app, or your possession or use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  7. Legal compliance. You confirm that you’re not located in a region that is subject to a US Government embargo, or that the US Government has designated as a “terrorist supporting” region, and that you’re not on any US Government list of prohibited or restricted parties.
  8. Our contact details. Questions, complaints or claims about the app should go to MOORFORGE LTD, 5 South Charlotte Street, Edinburgh, EH2 4AN, United Kingdom; email support@siteverity.com; telephone +44 7721 654650.
  9. Other companies’ terms. When you use the app, you must comply with any third-party terms that apply to you, such as your mobile network’s terms and, if you sign in with Google, Google’s terms.
  10. Apple can enforce these terms. You and we agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these terms, and that once you accept these terms, Apple will have the right (and will be treated as having accepted the right) to enforce them against you as a third-party beneficiary. This right can’t be withdrawn or changed without Apple’s agreement.

19. General

  • Transferring this agreement. We may transfer our rights and obligations under these terms to another organisation, for example if we sell our business. We’ll tell you if we do, and it won’t reduce your rights. You may transfer yours only with our written agreement.
  • Other people’s rights. Apart from Apple and its subsidiaries (section 18), nobody else can enforce these terms.
  • The whole agreement. If you’re a business customer, these terms (with our privacy policy and Schedule 1) are the whole agreement between us about SiteVerity, and you haven’t relied on anything else we’ve said. This doesn’t limit liability for fraud.
  • If part of these terms is invalid, the rest still applies.
  • If we don’t enforce a term straight away, we can still enforce it later.
  • How we contact each other. We’ll contact you in the app or at the email address on your account. You can contact us at support@siteverity.com.

20. Law and courts

These terms, and any dispute or claim about them or about SiteVerity, are governed by the law of Scotland. If you’re a business customer, the Scottish courts have exclusive jurisdiction.

If you’re a consumer, you can bring proceedings in the Scottish courts or in the courts of the part of the UK where you live (see section 16).

21. Contact us

  • Email: support@siteverity.com. We reply within two working days.
  • Post: MOORFORGE LTD, 5 South Charlotte Street, Edinburgh, EH2 4AN, United Kingdom.

Schedule 1: Data processing terms

This schedule applies when we process personal data in your projects on your behalf. It contains the terms that UK data protection law (Article 28 of the UK GDPR) requires between a controller and a processor. In this schedule, “personal data”, “processing”, “controller”, “processor”, “data subject” and “personal data breach” have the meanings they have in the UK GDPR, and “your personal data” means personal data in your content that we process for you.

1. Roles

You, or your organisation, are the controller of your personal data, and we’re your processor. Paragraph 7 describes the processing.

2. Your instructions

We’ll process your personal data only on your documented instructions, including instructions about transfers outside the UK, unless the law requires otherwise. If it does, we’ll tell you before we process it, unless the law forbids that. Your instructions are these terms and the way you use SiteVerity’s features, for example syncing a project, making a report or creating a share link. If we think an instruction breaks data protection law, we’ll tell you.

3. Our obligations

We will:

  1. make sure that everyone at MOORFORGE who can access your personal data is bound to keep it confidential;
  2. take appropriate technical and organisational measures to keep it secure, including those in paragraph 8;
  3. use other processors (sub-processors) only as paragraph 4 allows;
  4. help you, as far as we reasonably can given what we do, to respond to people exercising their data protection rights. You can deal with most requests yourself in the app, by viewing, correcting, exporting or deleting content. If someone sends a request about your personal data to us, we’ll pass it to you, and we won’t respond to it ourselves unless you ask us to;
  5. help you meet your obligations on security, personal data breaches, data protection impact assessments and consulting the ICO, taking into account what we do and the information available to us;
  6. tell you without undue delay after we become aware of a personal data breach affecting your personal data, and give you the information you reasonably need to deal with it;
  7. when our processing for you ends, at your choice, return your personal data to you and then delete it, or delete it without returning it, unless the law requires us to keep it. If we have to keep anything, we’ll tell you what and why. You can also export your reports and records yourself at any time. Deleting your account in the app deletes your personal data without returning it, so if you want it returned, ask us before you delete your account. After we delete your personal data:
    • copies in our backups are deleted within 35 days, though Google’s automatic deletion can occasionally run late, and our sub-processors may take up to 180 days to clear it from their own systems;
    • you instruct us to keep the identifiers of what was deleted, with none of its content, for 60 days, so that a restore from backup can never bring back data you’ve deleted;
    • if we rehearse or carry out a restore from backup, the files we check it with may contain your personal data. We keep them in restricted storage and delete them within 60 days;
  8. give you the information you reasonably need to show that we meet this schedule, and allow audits by you or an auditor you appoint, on reasonable notice, at your cost and no more than once a year, unless there has been a personal data breach, a regulator requires an audit, or you have reasonable grounds to believe we aren’t complying with this schedule. We may first answer in writing, and anyone carrying out an audit must keep what they learn confidential.

4. Sub-processors

You agree that we may use the sub-processors listed in paragraph 9. We’ll give you at least 30 days’ notice before we add or replace one, by updating the list on our website and telling you in the app or by email. If you object on reasonable data protection grounds, tell us. If we can’t resolve your objection, you may stop using SiteVerity and cancel your subscription before the change takes effect.

We’ll make sure each sub-processor is bound by data protection terms that protect your personal data as well as this schedule does, and we remain responsible to you for their work.

5. Transfers outside the UK

We’ll transfer your personal data outside the UK only where UK data protection law allows it, for example to a company certified under the UK-US data bridge, or under the UK’s standard data transfer clauses.

6. Your obligations

You confirm that:

  • you have a lawful basis for the personal data you put into SiteVerity, and for asking us to process it;
  • you’ve told the people concerned what the law requires you to tell them;
  • where your content includes special category data, such as information about someone’s health (for example, the Damp & Mould Investigation template’s question about anyone in the household being at higher risk, or the Legionella Risk Assessment (Domestic) template’s question about anyone at higher risk living in the home), you have a condition under data protection law for processing it, and you record only what you need;
  • your instructions to us comply with data protection law.

You’re responsible for who you send reports and share links to.
